Avia-Kombitur — Avia-Kombitur Limited Liability Company.
User — a legally capable individual aged 18 or over who is entitled by law to enter into contractual relations with Avia-Kombitur, including booking tickets and ordering services on the website www.aviabileti.kg. The User is also a person named as the recipient of a service, or a person who otherwise uses services purchased on www.aviabileti.kg. Services on the Site are purchased exclusively for personal, household and other needs. No services purchased on the Site may be connected with business activities.
Site — the Avia-Kombitur website on the Internet, available at www.aviabileti.kg. The User places Orders on this Site.
Order — a duly completed request by the User for the services selected on this Site.
User Account — the User's personal account with Avia-Kombitur.
Funds are credited to this account if a refund is made or the User cancels an Order they have paid for. These funds may be used as prepayment for the User's subsequent Orders with Avia-Kombitur or refunded to the User in the manner provided for by this Agreement.
Booking System — platforms or applications that connect the carrier with the passenger: an information system containing data on flight schedules, the number and availability of seats on flights, the various fares and services of air carriers and the rules for applying them, as well as many other terms of service. All this information is published on www.aviabileti.kg exactly as it is presented in the booking systems by the direct providers of these services (air carriers) or their authorised representatives. The information presented in the flight booking system may be changed or supplemented at any time. Therefore, the User is offered the booking system on an “as is” basis, as it is available at the given moment.
Operator — an Avia-Kombitur employee who processes User Orders that require individual “manual” handling.
Electronic Passenger Ticket — a passenger ticket issued in electronic form. This ticket is a document certifying the contract of carriage of the passenger and containing information about the carriage of the passenger. All information is provided to the User in electronic digital form. The passenger receives an e-ticket receipt in the form of an electronic ticket.

SECTION 1. General Provisions

1.1. By ordering Services through Avia-Kombitur, the User accepts the terms of this Public Offer Agreement (hereinafter, the Agreement) set out below. Avia-Kombitur provides the User with all available information contained in the booking system and books airline services through air travel booking services according to the parameters specified by the User (date, time, route, number of passengers and other terms of carriage), and also carries out the necessary processing of flight ticket refunds at the User's request.
1.2. This Agreement and the information about the services offered on the Site constitute a public offer.
1.3. Relations between the User and Avia-Kombitur are governed by the applicable legislation of the Kyrgyz Republic. Third-party air carriage services booked by the User are governed by the rules of the relevant carrier and the applicable fare. Fares for international routes that are non-refundable if the passenger cancels the carriage are also governed by international air transport regulations and the rules set by the relevant carrier. Accordingly, the User undertakes to read the fare rules for the selected flight ticket that Avia-Kombitur provides during booking.
1.4. All contracts for air carriage services, information about which is published on the Site, are concluded by the User directly with the providers of these services, i.e. the Carriers. The contract of carriage by air concluded between the User and the carrier is certified by the Electronic Passenger Ticket.
1.5. Avia-Kombitur reserves the right to amend this Agreement; therefore, the User undertakes to check regularly for changes to the Agreement on their own.
1.6. The User accepts this Agreement by ticking the box “I accept the terms of the public offer agreement” at the last step of placing an order on the Site. By this consent, the User confirms their legal capacity and rights and their financial solvency, and acknowledges responsibility for the obligations assumed upon entering into this Agreement. The User confirms the accuracy of their personal data and of the passengers' data and assumes full responsibility for their completeness and accuracy.
1.7. The User also assumes all possible commercial risks (placing a new Order, fare changes, refunds, etc.) arising from their actions involving errors or inaccuracies in the data requested by Avia-Kombitur.

SECTION 2. Rules for Registration on the Site

2.1. To place an order, the User must register on the Site and provide their e-mail address, to which the registration will be linked. If the User is not registered on the Site, Avia-Kombitur registers the User itself directly when the User places an order. Registration is made to the e-mail address entered by the User in the relevant field, which the User will subsequently use as the Login to sign in to their personal account on the Site. The password for the personal account on the Site will also be sent to the e-mail address provided by the User.
2.2. Avia-Kombitur bears no responsibility for the accuracy and correctness of the information provided by the User during registration.
2.3. The User undertakes not to disclose to third parties the login and password specified during registration on the Site. If the User suspects that their login and password are not secure or may be used by third parties without authorisation, the User undertakes to notify Avia-Kombitur immediately via the feedback form on our Site or by e-mail to [email protected]
2.4. All exchange of information between the parties regarding the User's order and the performance of their other obligations under this Agreement shall be carried out by e-mail. The User must provide an e-mail address during registration. Accordingly, until the ticket purchased on the Site is used, the User undertakes to monitor the status of their order regularly on their own, including by checking their e-mail for information about any changes. If necessary, the User may request information from Avia-Kombitur by the phone number shown on the Site or via the feedback form on the Site. The User bears responsibility for any consequences arising from the User's lack of information about changes to the Order that occurred for reasons beyond Avia-Kombitur's control (flight cancellation or rescheduling, a delay in payment for the Order by the User's bank, fare changes, etc.), provided that Avia-Kombitur has followed the procedure for notifying the User of any changes to the Order.

SECTION 3. Methods of Placing an Order and Order Confirmation Times

3.1. The User places the order on the Site independently. Airlines prohibit “double booking”. Only one order may be placed for one passenger with the same parameters (date, route, airline, flight) in order to avoid “double” booking. Airlines reserve the right, at their discretion, to cancel bookings, release seats and refuse boarding to passengers who have made a “double” booking in the System. Avia-Kombitur has the right to cancel one or both such bookings upon detecting them and bears no responsibility for any consequences of the User incorrectly placing more than one order for the same passenger with the same parameters, including where the original booking had not been paid by the User when the repeat booking was created.
3.2. When placing an order, the User must complete all fields marked as “required” in the booking system.
3.3. The User learns all the terms of the order during the booking process. The User must study all the terms of the order and clarify with the operator any terms of the order that are unclear, including the terms of refund, of making any changes to a placed order, or of cancellation.
3.4. The Avia-Kombitur data processing system automatically processes all Orders placed by the User, which are final. By paying for the Order, the User confirms their agreement with this offer agreement, as well as with all details of their trip, including flight details, departure and arrival dates, connection and transfer times, class of service and passenger data. After the User pays for the order, electronic tickets for the booked carriage services are automatically generated in the booking system or issued by an Avia-Kombitur operator in the booking system. Flight tickets issued by either of these methods are added to the User's personal account on the Site and sent to the e-mail address provided during registration. In some cases, tickets may be issued within 6 hours of payment for the Order. If information about the User's payment for the Order reaches Avia-Kombitur late, if the airline cancels the booking, or for other reasons beyond the Agency's control, the User's Order is cancelled and may be restored, subject to seat availability on the required dates, by being processed by an Operator who handles such Orders in order of receipt; in this case Avia-Kombitur cannot guarantee the availability of seats at the previously booked fare.
3.5. Any change to the personal data of one or more passengers in a placed and paid order results in the loss of the fares agreed in the order and is possible only by refunding that flight ticket, with all penalties provided for by the fare withheld, and placing a new Order. Accordingly, the User assumes all possible commercial risks (change in the ticket price, placing a new order, fare change, refund, etc.) arising from their actions, errors or inaccuracies in the data requested by Avia-Kombitur when placing the order.

SECTION 4. Payment for the Order. Avia-Kombitur Service Fee

4.1. The cost of the Order is determined when the Order is placed and includes the airline's fare for carriage under the flight ticket and the Avia-Kombitur service fee for the necessary services of booking and issuing flight tickets. The cost of the Order is set in the national currency of the Kyrgyz Republic, the Kyrgyz som (KGS). On the Site, the cost of the Order is shown online and may be changed unilaterally by the airline. If errors in the cost of the order arise in the booking system independently of Avia-Kombitur's actions, the company will inform the User as soon as possible in the manner provided for in clause 2.4 of this Agreement. The User may confirm the order at the correct price or cancel it if they disagree. If it is impossible to contact the User within 24 hours by the method specified in clause 2.4 of this Agreement, the User is deemed not to agree with the price change, and the order is therefore cancelled. Where an Order cancelled under this clause has been paid, Avia-Kombitur transfers the funds paid for the Order to the User Account, from which they may subsequently be refunded upon a written application.
4.2. The payment deadline for the Order (time limit) is shown on the Site when the Order is placed, and in the service e-mail that Avia-Kombitur sends to the User with the Order status “Order accepted”. If the User misses the payment deadline or the payment arrives after the deadline, the Order placed by the User will be cancelled. An Order paid after the deadline may be restored by an Avia-Kombitur operator if a flight ticket matching all parameters of the cancelled Order (dates, route, flight, class of service, fare, price and other terms) is available in the booking system. To do so, the User must contact Avia-Kombitur with a corresponding request via the feedback form or by the phone number shown on the Site.
4.3. Avia-Kombitur reserves the right to charge the User additional service fees for booking and issuing electronic tickets, as well as for processing refunds and changes of tickets already issued. Whether these fees apply and their amount depend on the airline's terms. The cost of the ticketing service is included in the cost of the order and is non-refundable if the User voluntarily returns the tickets. The service fee for a ticket refund is set by Avia-Kombitur unilaterally; the exact amount should be checked with the operator.
4.4. The methods of payment for the Order are shown on the Site.
4.5. Specifics of paying for an order by bank card:
4.5.1. Bank card transactions are carried out by the cardholder or a person authorised by the cardholder.
4.5.2. The procedure for paying by bank card is described on the Site.
4.5.3. Credit card transactions are authorised by the payment system through which the payment transaction is made. If the payment system has grounds to believe that a transaction is fraudulent, the system is entitled to decline the transaction.
4.5.4. To prevent any kind of misuse of bank cards for payment, all Orders placed on the Site and paid by bank card are checked by Avia-Kombitur. In accordance with the rules governing international payment systems, to verify the identity of the cardholder and their right to use the card, the User who placed the order must, at the operator's request, provide two pages of the credit card holder's passport (the photo page spread) and a copy of both sides of the credit card (with the card number covered except for the last four digits). These may be provided by e-mail as scanned copies. If the User does not provide the requested documents within the time specified in Avia-Kombitur's request, or if there are doubts as to their authenticity, the company reserves the right to cancel the Order without giving reasons. In this case, the cost of the Order is refunded to the cardholder's card, less the bank's transfer fees (if any).

SECTION 5. Changes to the Order. Cancellation of Airline Services

5.1. All terms of the order, including any changes to placed (issued) Orders (electronic tickets), ticket refunds, cancellation of the air carriage service and other terms of air carriage services, are governed by the fare rules for the service set by the airline, the airline's public offer contract of carriage by air, this agreement, the applicable legislation of the Kyrgyz Republic and applicable international law.
5.2. All modifications to a booked and paid order will be made in accordance with the procedures set out in the “Flight Ticket Change Rules” section, which forms an integral part of this Agreement. A round-trip ticket or a ticket on any route with a connection purchased by the User, or a ticket for a complex itinerary with several destinations, including a surface segment, is a single ticket consisting of several flight segments. Changing individual destinations on such a ticket without the airline's approval will result in cancellation of the order and the issue of a new one for the selected route. As a general rule, failure to use one of the flight segments of such a ticket results in the airline cancelling all subsequent flight segments. To find out whether the flight segments of a round-trip ticket or another type of ticket specified in this clause can be used separately (in case of a missed flight and similar situations), the passenger must contact the airline providing carriage on the selected route.
5.3. If for any reason the User wishes to cancel an order, they may: - cancel an unpaid order on the Site in the “My Orders” section; - request a refund for a paid order by sending a specific request from the personal account in the manner provided for in the “Flight Ticket Refund Rules” section, which forms an integral part of this Agreement. If the User cannot request a refund from the personal account (no internet access, etc.), the User must call the company at the phone number shown on the Site and speak to an Operator to check orally whether the Order/tickets can be cancelled and, if this is confirmed, cancel the order/cancel the tickets/release the seats.
5.4. An Order is considered cancelled by Avia-Kombitur once it has been assigned the status “Cancelled” in the Avia-Kombitur System. Tickets are refunded in the manner provided for in the “Flight Ticket Refund Rules” section, which forms an integral part of this Agreement.
5.5. If the User cancels a paid order for which Avia-Kombitur has received payment, the cost of the cancelled order, less Avia-Kombitur's actual expenses, will be refunded to the User using the details specified in the refund application, after the relevant permission has been received from the airline. Actual expenses are expenses incurred by Avia-Kombitur in arranging the fulfilment of the User's flight ticket booking order, including penalties withheld by airlines and other persons providing ticketing services, as well as the Avia-Kombitur service fee for the services provided.
5.6. Funds will be refunded to the User in accordance with the “Flight Ticket Refund Rules” section, which forms an integral part of this Agreement. The User's funds credited to their Account may be used by the User to pay for future orders or may be refunded to the User using the details provided by the User in the Refund Application.
5.7. More detailed information on the terms of order cancellation and refunds is given in the “Flight Ticket Refund Rules” section, which forms an integral part of this Agreement.

In these cases, air carriers are liable to passengers in accordance with international rules and the applicable legislation of the Kyrgyz Republic. Passenger claims are considered by carriers on the basis of the legislation of the Kyrgyz Republic and the rules of international carriage; — for the actions of customs and immigration authorities; — for restriction by the competent authorities of the relevant country of a passenger's right to leave the Kyrgyz Republic or another point of departure; — for the actions of consulates of foreign states, including delays, refusals or changes in the timing of issuing entry visas; — for the consequences of a passenger's breach of customs and border formalities, rules of travel and baggage carriage, or special rules of conduct in the country of temporary stay; — for passengers not having international passports issued by the start of the trip, or the relevant documents governing travel abroad by minors under 18; — for the authenticity and correct completion of passenger documents (the accuracy of the information they contain). — for passengers failing to appear or arriving late for flight check-in; — for a passenger not having the necessary travel documents received from Avia-Kombitur; — for passengers' non-compliance with the rules of conduct on board aircraft set by the carrier;
6.2. The User (passenger) confirms and warrants that they are aware of and agree with:
— the requirements for the completion and availability of documents required for the trip, and assumes full responsibility for preparing all necessary travel documents. The passenger should independently familiarise themselves with and comply with all requirements of the country of destination, including requirements for the documents needed on departure and arrival, the need to obtain visas, the need to buy a return ticket when entering a visa-free country for citizens of a country that has an equivalent agreement with the Kyrgyz Republic, or other entry requirements (medical insurance for foreign tourists, proof of sufficient funds, etc.). Also the need to obtain other documents for travel by minors under 18, for animals, permits to export weapons and works of art, and other permits and approvals. Avia-Kombitur is not liable for the passenger's ignorance of or non-compliance with these requirements;

— the conditions of carriers' fares, including the terms of ticket refunds and changes, as well as the conditions under which carriers operate connecting flights if a ticket with a connection is issued (sufficient connection time, transit visas, etc.);
— the specifics and rules of border (customs) control (regime) of the Kyrgyz Republic and foreign states;
— the obligation to comply with customs and border rules; — the fact that deportation of a passenger with invalid entry or exit documents is carried out solely at the passenger's expense. The passenger must obtain the necessary information about the deportation procedure from the consulate of the relevant country on their own.
— the fact that passengers themselves bear full responsibility for the validity of their international passports, consents for travel abroad by minor children and other documents required to cross the border, and for the accuracy of the information contained in these documents;

6.4. Upon the occurrence (and cessation) of the circumstances specified in clause 6.3 of this Agreement, the party for which it has become impossible to perform its obligations under this agreement must notify the other party immediately. Failure to notify or late notification of such circumstances deprives the parties of the right to rely on them and does not release them from any liability under this Agreement. The time for the parties to perform their obligations under this agreement is extended in proportion to the duration of such circumstances. If the circumstances continue for more than 14 (fourteen) days, each Party will have the right to refuse to perform its obligations under this agreement. The existence of such circumstances is confirmed by the relevant decisions of territorial bodies of state power and local self-government bodies, adopted by them in accordance with the laws of the Republic.
